THE FOLLOWING PROMOTION IS INTENDED FOR VIEWING IN THE UNITED STATES (EXCLUDING PUERTO RICO) AND CANADA ONLY AND SHALL ONLY BE CONSTRUED AND EVALUATED ACCORDING TO UNITED STATES LAW. DO NOT PROCEED WITH THIS SWEEPSTAKES IF YOU ARE NOT LOCATED IN THE UNITED STATES (EXCLUDING PUERTO RICO) OR CANADA. 1.NO PURCHASE NECESSARY. Open to legal residents of the United States, (EXCLUDING PUERTO RICO), and Canada who are 13 years old or over as of the date of entry, provided that residents of the province of Quebec may play and have their places noted in the standings, but are not eligible to win any prizes. Canadian winners will be required to take and pass a timed mathematical skill testing question. Minors who are 13 years old or over must first obtain permission of parent/legal guardian before entering online. Offer void where prohibited by law. 3 Play begins at 12:00 a.m. PT on Monday, May 1, 2000 and ends at 11:59 p.m. PT, Wednesday, May 31, 2000 (the "Game Period"), and consists of daily games which run every day during the Game Period For purposes of these Official Rules, all times are Pacific Time (PT). 2.HOW TO ENTER: To enter 3 Play, go to the web site at http://www.espn.go.com and click on the link located on the popup or on the 3 Play game page. Only online entries through the registration page will be accepted. No faxed, mailed, e-mailed, or phoned in entries are allowed. You must have Internet access on or prior to the date you enter to be eligible to participate. You must be a registered member of espn.go.com to enter. Registration is free. You can enter in one of the following ways: a) If you are an existing espn.go.com member, you should sign in on the popup or on the 3 Play game page with your current member name and password. No other additional information will be requested. b) If you are not an espn.go.com member, you can register by clicking on the link located on the popup or the 3 Play game page. You will be asked to provide your name, address, daytime and nighttime phone numbers, e-mail address, gender, and birthday and to select a member name. Espn.go.com will then send you a password to the specified e-mail address, after which you can sign in with your member name and password. MINOR POLICY: Users under the age of 13 may not play 3 Play. If you are between the ages of 13 and 18, you must first obtain permission of parent/legal guardian before entering online; you may enter only after becoming a registered member and providing their parent or legal guardian's e-mail address. EIV will notify the parent or legal guardian when their child has become a registered member of espn.go.com. You may be asked to consent to receive promotional e-mails from 3 Play sponsors and reminders for upcoming Go Network promotions. Consenting to receive promotional or reminder e-mails is optional and does not have to be agreed to in order to be eligible to enter 3 Play. After entering as described above, EIV will randomly assign to you three (3) cards, or game pieces (the "Cards"), which will include an athlete, team or other sporting entity, and inform you of that day's Daily Bonus Threshold (see below). The Daily Bonus Threshold shall be set by EIV for each day in its sole discretion. Each Card will indicate how many points you will accumulate based on the athlete, team, or entity's performance in a specific athletic competition scheduled to take place on that day (for example, you may receive 2 points for each home run hit by a certain baseball player in that night's game). EIV will keep track of your accumulated points and you can check your scorecard at any time. The entrant(s) whose Cards have accumulated the most points each day will be eligible for a random drawing for a daily prize (see details below). The entrant who wins the daily prize will also be awarded a Daily Bonus Pool (see below) if his or her points meet or exceed the Daily Bonus Threshold for that day. If the Daily Prize Winner's points do not meet or exceed the Daily Bonus Threshold, the Daily Bonus Pool will be added to the next day's Daily Bonus Pool. For example, if the Daily Prize on May 4th is $2,500, the Daily Bonus Pool is $3,000 and the Daily Bonus Threshold is 4,000 points, and the entrant chosen in the May 4th daily random drawing has accumulated less than 4,000 points, the entrant will be awarded the Daily Prize, or $2,500, but the Daily Bonus Pool, or $3,000, will be added to the May 5th Daily Bonus Pool. If the May 5th Daily Prize Winner also fails to meet the May 5th Daily Bonus Threshold, the May 4th and May 5th Daily Bonus Pools shall be added to the May 6th Daily Bonus Pool. Further, if the Daily Prize Winner on May 31, 2000 does not qualify for the Daily Bonus Pool, any monies remaining in the Daily Bonus Pool on that date will not be awarded. Entries for each daily game must be must be received by ESPN/Starwave Partners d/b/a ESPN Internet Ventures ("EIV") between 12:00 a.m. and 11:59 p.m. PT of the game day. In the event a scheduled athletic competition listed on a Card does not occur as scheduled (i.e., a game is cancelled) or the sporting entity listed on the Card does not compete as scheduled (i.e., a player withdraws or is benched), no points will be awarded with respect to that Card). LIMIT: ONE ENTRY PER PERSON OR E-MAIL ADDRESS (REGARDLESS OF WHETHER MORE THAN ONE PERSON USES THE SAME E-MAIL ADDRESS) PER DAY. E-MAIL CHANGE OF ADDRESS POLICY: It is the sole responsibility of the entrant to notify EIV in writing if the entrant changes his/her e-mail address. (To do so, write to: ESPN.com 3 Play Change of Address, EIV c/o GO.com 506 Second Avenue, Suite 2100, Seattle, WA 98104). By entering the game, the entrant grants permission to EIV and the 3 Play sponsors listed on the game pages (the "Sponsors") to use their names, photographs, likenesses, voices, prize information and/or biographical information for publicity and promotional purposes without further compensation, unless prohibited by law.
3. PRIZE DRAWING(S): All prize drawings will be conducted by EIV, 506 Second Avenue, Suite 2100, Seattle, WA 98104. By participating, entrants agree to the Official Rules and the decisions of EIV, which shall be final and binding in all respects.
4. PRIZE(S); APPROXIMATE RETAIL VALUE/ODDS OF WINNING:
Daily Bonus Pool(s): Total ARV of all prizes: $190,000 Odds of winning depend on the number of eligible entries received. ALL FEDERAL, STATE AND LOCAL TAXES ASSOCIATED WITH THE RECEIPT OR USE OF ANY PRIZE ARE THE SOLE RESPONSIBILITY OF THE WINNER. Winner is solely responsible for any and all taxes on prize, as well as any and all expenses relative to participation in 3 Play (including acceptance of prize) not specified herein. Prize returned as undeliverable or otherwise not claimed within fourteen (14) days after being sent will be forfeited and awarded to an alternate winner. Prize is not transferable. 5. ELIGIBILITY: Employees or agents of EIV, any Sponsor, and their respective parent companies, affiliates, subsidiaries, advertising/promotional agencies, and the members of their immediate families or those persons living in the same household of such individuals are ineligible to enter or win. All federal, state and local laws and regulations apply. Void where prohibited by law. 6. CONDITIONS OF PARTICIPATION: If potential winner does not respond to notification within ten (10) days of its transmission, or should an e-mail notification, after up to three (3) attempts, be returned as undeliverable, the potential winner will be disqualified and an alternate winner will be selected. Prize Winners will be required to sign and return an Affidavit of Eligibility, a Liability Release, and, where legal, Publicity Release, within seven (7) days of the date printed on the prize notification. In the event of non-compliance with these requirements, winner may be disqualified and an alternate winner selected. EIV reserves the right, in its sole discretion to cancel, terminate, or suspend 3 Play should viruses, bugs, unauthorized human intervention or other causes beyond the reasonable control of EIV, corrupt or impair the administration, security, fairness, or proper play of the 3 Play or make 3 Play impracticable to continue. In such event, the prize winners will be selected by random drawing from all eligible entries received up to the time of such cancellation, termination or suspension. Minors will be required to provide EIV with a Parental Permission Form, which will be sent to all potential prize winners who are minors. To be eligible to receive prize, the Parental Permission Form must include a parent's or legal guardian's signature (signifying approval of child's entry in contest) and be returned by mail (or by fax) to the address (or fax number) indicated on the Form within fourteen (14) days of notification. Any minor who does not provide this completed and executed Parental Permission Form within fourteen (14 days) will forfeit his or her right to be declared a winner and/or win a prize. Players agree to abide by the terms of these Official Rules and by the decisions of the judges, which are final on all matters pertaining to 3 Play. 3 Play is governed by, and these rules will be construed and interpreted pursuant to, the laws of the United States. All federal, state and local laws and regulations apply. EIV is not responsible for typographical or other errors in the offer or administration of 3 Play, including but not limited to errors in advertising, the Official Rules, the selection and announcement of the winners or the distribution of the prizes. 7. CONDUCT: The Official Rules will be posted at the contest web site throughout the contest. EIV reserves the right at their sole discretion to disqualify any individual they find to be tampering with the entry process or the operation of the contest or web site; to be acting in violation of the Official Rules; or to be acting in an unsportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten or harass any other person. EIV reserves the right to lock out an entrant whose eligibility is in question or who has been disqualified or is otherwise ineligible to enter the contest. CAUTION: ANY ATTEMPT BY AN ENTRANT OR ANY OTHER INDIVIDUAL TO DELIBERATELY ALTER OR DAMAGE ANY WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF 3 PLAY IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, EIV RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH ENTRANT TO THE FULLEST EXTENT PERMITTED BY LAW. 8. LIMITATIONS OF LIABILITY: Neither EIV nor Sponsors are responsible for any incorrect or inaccurate information, whether caused by web site users or by any of the equipment or programming associated with or utilized in the contest or by any technical or human error which may occur in the processing of submissions in the contest. EIV's judgment regarding all scoring matters is deemed final at the time EIV calculates such scores and shall not be subject to any retroactive scoring changes. EIV and Sponsors assume no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft of or destruction or unauthorized access to, or alteration of, entries. Neither EIV nor Sponsors are responsible for any problems or technical malfunction of any telephone network or lines, computer online systems, servers or providers, computer equipment, software, failure of email or entrants due to or resulting from technical problems or traffic congestion on the Internet or at any web site or combination thereof, including injury or damage to participants or to any other person's computer related to or resulting from participating or downloading materials in this contest. 9.
