The family of Brian Cole, a top prospect for the New York Mets who died in an automobile accident on March 31, 2001 while leaving spring training, is due back in court this week in Laurel, Miss., for another attempt at a civil suit over his death.
In February, the second attempt ended in a hung jury when nine of 12 jurors were unable to agree on a verdict.
The civil lawsuit alleges a faulty seatbelt design and the propensity of Ford Explorer SUV's to roll over after tire blowout led to the fatal accident. Ford has countered that excessive speed caused the accident.
