Fan gets court date moved for title game

Who wants to be in an Indiana courtroom instead of Sun Life Stadium on Jan. 7?

Certainly not an attorney in the case of Arttemis and Elizabeth Hendally v. Essroc Cement Corp., as the counsel field a motion to delay a pretrial conference that was scheduled for the same date as the Discover BCS National Championship between Notre Dame and Alabama.

The best part? U.S. District Court Judge Rudy Lozano granted the request in part to the Hendallys' attorney, who is a Notre Dame alumnus.

One day after the request was filed, on Dec. 13, Lozano wrote:

As an Indiana University graduate, I am not particularly sympathetic to this request. Nonetheless, I am hoping not to get coal in my stocking for Christmas, and in the spirit of the season, the request is GRANTED IN PART. This Court’s calendar does not permit the conference to be rescheduled for a later date without also necessitating a continuance of the trial. However, it can be scheduled at an earlier date.

The 1 p.m. Jan. 7 final pretrial conference will now take place at 10 a.m. on Jan. 4, for those wondering ... meaning the parties should have more than enough time to get settled before that night's AT&T Cotton Bowl.
