Contest is open to all legal New York City tri-State (NY, NJ, CT) residents age 18 years and older.
Any individuals (including but not limited to employees, consultants, independent contractors, and interns) who have, within the past six months, performed services for ESPN New York (WEPN-FM), any organizations responsible for sponsoring, fulfilling, administering, advertising or promoting the contest or supplying the prize, and their respective parent, subsidiary, affiliated and successor companies, and immediate family and household members of such individuals, are not eligible to enter or play. "Immediate family members" shall mean parents, step-parents, children, step-children, siblings, step-siblings, or spouses. "Household members" shall mean people who share the same residence at least three months a year.

Text-to-win sweepstakes will air on WEPN-FM from September 12 – October 2, 2013 (M-F). Weekday giveaways will take place between the hours of 2P-7P EST: • Stephen A. Smith & Ryan Ruocco 1-3PM (ET) • The Michael Kay Show 3-7PM (ET) Within the designated shows with the duration of the campaign, listeners will be encouraged to tune-in and listen for a series of clues. Clue #1 will reveal the mystery person of the day. Following Clue #1, a series of two questions will then be asked about the mystery person of the day. The show will then instruct listeners when to text their answers to all three questions. Sample Answer – Babe Ruth, Bambino, 714
Due to other programming commitments, there may be a number of dates when WEPN, at its sole discretion, will preempt a particular opportunity to enter. In that event, if time permits, the opportunity to enter may be presented on a different hour.)

Sponsor is not responsible for failed, partial or garbled mobile transmissions, or for technical failures of any kind, including but not limited to electronic malfunction or damage of any network, hardware or software. If for any reason the contest is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or other causes that corrupt or affect the administration, security, fairness, integrity or proper conduct of the contest, Sponsor reserves the right, in its sole discretion, to disqualify any individual who tampers with the entry process, and to cancel, terminate, modify or suspend the contest. No responsibility is assumed for: any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, entries; or any problems or technical malfunctions of any telephone network or lines, computer online systems, servers, providers, computer equipment, or software; or failure of any e-mail or electronic entry to be received on account of technical problems or traffic congestion on the Internet or at any Web-site, or any combination thereof, including any injury or damage to entrant's or any other person's computer related to or resulting from participation in or downloading any materials from this contest. In the event of a dispute over an electronic entry, prize will be awarded to the owner of the e-mail account, not the name on the entry form.
IV. HOW AND WHEN WINNERS WILL BE SELECTED AND NOTIFIED
The day following each giveaway, WEPN-FM will select three (3) daily winners. One Winner from Stephen A. Smith & Ryan Ruocco Two Winners from The Michael Kay Show
People or household members of people who have won any other prizes from WEPN-AM within 90 days of entry are not eligible to enter this contest. Any person who has won prizes of $600 or more within the last 6 months from WEPN-FM is ineligible to enter or win.
The following classes of people shall be INELIGIBLE to participate: a. Current or former professional or semi-professional football, soccer, and rugby players and coaches who have played or coached at that level anywhere in the world. b. Current or former collegiate or junior collegiate football, soccer, and rugby players and coaches who have played or coached at that level anywhere in the world within the past five (5) years. c. Current or former high school football, soccer, and rugby players and coaches who have played or coached at that level anywhere in the world within the past five (5) years. d. Current or former Olympic soccer and rugby players and coaches who have played or coached at that level anywhere in the world within the past five (5) years. e. Current or former employees, family members, agents, successors, or assignees of the client or any promotional agency involved with this promotion.
Odds of being the daily qualifier depend on the number of texts received during each text-to-win prompt. Odds to win the Grand Prize trip depend on how many daily qualifiers are in attendance.
Daily Prize: Three (3) Winners each day will win $987.00.
Potential for maximum of Forty Five (45) Total Daily Winners.
Grand Prize: Three (3) Grand Prize winners will be selected from a list of all eligible daily winners. Those three (3) winners will receive two (2) ticket to watch Jets vs. Patriots on Sunday, October 20th at 1:00PM.
1 Promotion contestants must be selected as follows: Qualifiers will be selected on-air. Sponsor will send to Odds on Promotions (OOP) the entire database of on-air qualifiers prior to Friday, October 18, 2013. Upon receipt, OOP will randomly draw three (3) finalists to participate in the insured promotion on October 20, 2013. 2. Contestants shall not be permitted any practice, warm-up, or qualifying passes, punts, or kicks, at any time after his/her notification of participation in the promotion until the actual prize attempt(s). 3. All contestants must sign the "CONTESTANT AGREEMENT TO PARTICIPATE" form prior to grand prize contest participation.
At halftime of the game, winners will be escorted onto the field to participate in the pass/punt/kick challenge.
1. In order to qualify for prize reimbursement, Three (3) eligible contestants, using a regulation NFL football, must successfully: a. Start from behind the end line (back line of end zone) and PASS the football towards the opposite end zone, then; b. The top Two (2) contestants who passed the ball furthest will then start from behind the exact spot where their previous pass first hit the ground or crossed a sideline out of bounds, and PUNT the football towards the same end zone, then; c. The One (1) contestant who punted the furthest, with the ball placed at the exact spot where their previous punt first hit the ground or crossed a sideline out of bounds, must successfully KICK a field goal through the regulation goal posts at the opposite end of the field from where the sequence started. 2. It is imperative that the EXACT spots where each pass and punt FIRST hit the ground or cross a sideline out of bounds are marked and that each spot becomes the spot where the ensuing punt or kick is initiated. Moving the starting point of either the punt or kick towards the center of the field is prohibited. 3. No form of kicking tee or other artificial means of elevating the ball may be used during 3-c (the kick) above. Contestant must have a holder to keep the ball upright and one end of the ball must be touching the ground. 4. No form of football or soccer kicking shoe may be used. 5. NOTE: Contestant is allowed to start the kick from no more than FOUR (4) YARDS away from the ball. The intent of this clause is to restrict the Contestant's approach to a normal TWO (2) step Field Goal Kick approach prior to kicking the ball. 6. No part of the contestants' bodies or clothing may come in contact with the demarcation lines/spots prior to passing, punting, or kicking the ball. Any such contact shall constitute a foul and the prize attempt shall be considered missed.
Retail Value of Tickets - $1,000.00
Cash Value if Contest is Won - $500,000 1. Hole In One International/Odds On Promotions reserves the right to fund the prize annuity in one or more of the following ways:
a. Yearly installments made payable to the promotion Winner equal to the Prize Value divided by the length of the annuity contracted for (i.e. $500,000 prize / 40-year annuity = $12,500 per year installments for 40 years). Installments shall commence at the conclusion of the claim investigation and will be made the same date each year.
b. Purchase a single premium deferred annuity, from an A.M. Best rated "B" or better Legal Reserve Life Insurance Company, with annual installments equal to the Prize Value divided by the length of the annuity contracted for. The selection of said company will be at the sole discretion of Hole In One International/Odds On Promotions.
c. Purchase any other investment grade funding vehicle or financial instrument, which shall be sufficient to meet the obligations described herein. The selection of said instruments will be at the sole discretion of Hole In One International/Odds On Promotions.
2. Promotion winner shall not sell, transfer, encumber, assign, or otherwise dispose of all or any portion of the prize annuity without the written consent of Hole In One International/Odds On Promotions in its sole and absolute discretion. Notwithstanding the foregoing, the promotion winner's rights to payment shall be transferable to his or her heirs upon death. Hole In One International/Odds On Promotions' payment obligations with respect to the prize annuity exist only as to the promotion winner and his or her heirs upon death and not to any other third party.
All other travel, meals, and any other expenses associated with this event are the sole responsibility of the winner. Federal, state and local taxes are the sole responsibility of the winners, who will receive an IRS Form 1099 reflecting the final actual value of any prize valued at $600 or more. Tickets must be used on designated date of October 20, 2013. No alternative date will be made available. Winners are not entitled to exchange or transfer prizes or to obtain cash or other substitutes, but Sponsor in its sole discretion may substitute prizes of equal or greater value.
Sponsor is not responsible for cancellation or preemption of event or for other circumstances that make it impractical or impossible to fulfill this element of the prize. This element of the prize has no approximate retail value, and if it becomes impractical or impossible to fulfill this element, Sponsor's only obligation will be to provide the remainder, if any, of prize.
By participating, entrants agree to be bound by these official rules and the decisions of the Sponsor/Judges and the contest administrator, which shall be final in all respects.
By participating in this contest and/or accepting any prize that they may win, entrants agree to release New York FM Radio, their respective parent, subsidiary, affiliated and successor companies, advertising and promotion agencies and prize suppliers, and each of their respective officers, directors, agents, representatives and employees, as well as each of their respective successors, representatives and assigns (collectively, the "Released Parties") from any and all actions, claims, injury, loss or damage arising in any manner, directly or indirectly, from participation in this sweepstakes and/or acceptance or use of the prize.
Entrants authorize the Released Parties to use their name, voice, likeness, biographical data, city and state of residence and entry materials in programming or promotional material, in any media now known or hereafter created or conceived, worldwide in perpetuity, or on a winner's list, if applicable, without further compensation unless prohibited by law. Sponsor is not obligated to use any of the above mentioned information or materials, but may do so and may edit such information or materials, at Sponsor's sole discretion, without further obligation or compensation.
By submitting entry materials, entrants certify that such materials are original and created by entrant, that entrants have the necessary rights, permission and authority to submit such materials, and, if applicable, that entrants maintain a valid copyright in the materials. Entrants acknowledge that such materials may be include and/or discussed in a broadcast, that such discussion may include statements or opinions by the broadcast talent or others about the entrants, the entrants' appearances and/or the materials, and that those statements and opinions may be considered surprising, humiliating, embarrassing, derogatory, defamatory or otherwise offensive or injurious to them, Sponsors' employees, its studio or at-home audience and/or other third parties. Entrants release the Released Parties from any actions, claims, injury, loss or damage allegedly caused, directly or indirectly, by any such statements or opinions made during a broadcast.
VII. MISCELLANEOUS; WINNERS' LIST
Void where prohibited. All federal, state and local laws and regulations apply.
Sponsor reserves the right, in its sole discretion, to disqualify any individual who tampers with the entry process and to cancel, terminate, modify and/or suspend the contest in the event of tampering or other circumstances, including but not limited to acts of God or civil disturbance that render it impractical or impossible to complete or fulfill the contest as originally planned.
