"If the officer doesn't show for court, everything is dismissed,'' Debbie Pruett of the Lincoln County, Ga., probate office told The (Nashville) Tennessean. "Brandon had an attorney, and she requested it be dismissed for a lack of prosecution, and the judge had no bearing to change it. It's completely closed."
The 23-year-old Barden was arrested on Feb. 23 after he lost control of a truck carrying two other passengers and crashed into a ditch in Lincolnton, Ga., -- about 35 miles northwest of Augusta. The report says the truck flipped and landed on its side.
Deputies say they spoke with Barden after the accident and smelled a strong odor of alcohol. They said Barden refused to do a sobriety test and was taken to the sheriff's office, where he again refused to take a sobriety test.
He had been charged with DUI and failure to maintain lane.
Barden lives in Lincolnton and played for Vanderbilt University. He was drafted in 2012.
