Seattle syndicate defends itself against allegations

AUCKLAND, New Zealand -- Seattle's OneWorld has been accused of ''gross multiple violations'' of the America's Cup protocol by rivals who have demanded its disqualification from the challenger series.

Senior challengers Prada of Italy and Stars & Stripes of New York have jointly demanded the Cup Arbitration Panel hear new allegations OneWorld obtained and made use of confidential design and performance information belonging to other teams.

Prada and Stars & Stripes are currently involved with OneWorld in quarterfinal repechages. The racing Sunday was called off due to high winds.

The five-member Cup Arbitration Panel found in August that the Seattle Yacht Club team possessed secret design information belonging to defenders Team New Zealand, challenger champions Prada and 1999 challengers America True.

While describing data obtained by OneWorld as potentially ''vital,'' the panel ruled the team had not used the information and should not be expelled from the Cup. OneWorld was penalized one competition point and ordered to pay $13,500.

In their application and submissions to the panel, Stars & Stripes and Prada said they have ''new information evidencing extensive additional violations of the Protocol by (OneWorld).''

Those violations comprise the possession and use of other syndicates' design and performance information and the nondisclosure of information to the Panel.

Prada and Stars & Stripes contend ''the conduct alleged is of such seriousness that it must be thoroughly considered by the panel.

''It is the intent of the applicants to prove by papers and by a hearing multiple gross violations of the protocol, being matters not previously put before the panel.''

The case will rely strongly on affidavits sworn in June and August by OneWorld's former operations manager Sean Reeves, who was employed as rules adviser by Team New Zealand from 1994-2000.

In a summary judgment released in September, the Federal Court at Seattle found Reeves breached terms of his employment by OneWorld by attempting to sell design information to its rivals. It awarded damages against Reeves amounting to more than $500,000.

The court additionally imposed a restraining order on Reeves, preventing him from discussing matters OneWorld regards as confidential.

For that reason, Reeves has refused to provide a further affidavit in support of the Prada and Stars & Stripes action, nor is he likely to be able to testify before a panel hearing.

OneWorld executive director Bob Ratliffe on Sunday angrily attacked the joint action.

''It's drivel,'' Ratliffe said. ''It's not made from whole cloth.These are desperate acts by desperate people who don't have enough guts to get out on the water and attempt to win this thing like sportsmen.''

Ratliffe said OneWorld would defend the action.

''The burden of proof in this case is on Prada and Team Dennis Conner (Stars & Stripes) and not on OneWorld. We're ready to meet them at any hearing and to see this thing dealt with once and for all.

''I'm prepared to submit to a polygraph and to allow any of our team to submit to a polygraph because there is absolutely nothing that we have to hide.''
